This confirms the terms and conditions applicable to the Gullivers Travel Associates (Hong Kong) Limited (Company Number 804934) of Unit 708A, 7th Floor, Tower B Manulife Financial Centre 223-231 Wai Yip Street Kwun Tong, Kowloon Hong Kong (“GTA”) booking rewards program offered by GTA to certain Participant(s).
By accessing and redeeming Rewards on G Shop Participants are taken to agree and be bound by the terms and conditions set out below.
In these terms and conditions the following definitions apply:
a. “Client “means a customer who is authorised to make purchases via the GTA Systems pursuant to an agreement with GTA.
b. “Fit Product(s)” means the fully independent travel accommodation and destination services sold by GTA to Client via the GTA Systems.
c. “GShop Rewards Program” means the booking rewards program offered by GTA via GShop.
d. “GShop” means the online store operated by GTA where Reward Points can be used to redeem available Rewards.
e. “GTA Systems” means the GTA wholesale booking system, the GTA retail booking system and the XML Interface but excludes any and all offline bookings made via the GTA customer service centres.
f. “Reward(s)” means the products and/ or services which are available for redemption in GShop.
g. “Reward Points” means the points which accrue for each booking of eligible FIT Products made via the GT Systems which have been consumed i.e. used and paid for in full.
h. “Retailer” means the businesses whose products and/or services are available for redemption in GShop.
i. “‘Participant (s)” shall mean either the GTA Client or, at its election, its employees or agents who have registered their participation in the GShop Rewards Program.
a. A valid agent booking id is required in order to be eligible to take part in the GShop Rewards Program.
b. Client can elect for the Reward Points to be allocated to it or to any of its employees or agents. Such election must be made in writing at the time of registration. However, Reward Points only accrue once.
c. Client agrees that it has no objection to its employees and/ or agents participating in the GShop Rewards Program and redeeming Rewards on GShop.
d. Participants warrant that, where required, they have obtained the necessary permission of their employer or principal (in the case of an agent) to take part in the GShop Rewards Program.
B. REWARDS AND REWARD POINTS
a. Reward Points accrue on bookings of eligible FIT Products made via the GTA Systems which have been consumed i.e. used and paid for in full.
b. Reward points accrue with the first booking of eligible FIT Product made via GTA Systems pursuant to registration for the GShop Rewards Program.
c. Reward points accrue based on the net rates of the eligible FIT Product booked.
d. Reward points have no monetary value and are only for use on GShop.
e. Reward Points are not redeemable in cash, cannot be exchanged, replaced, sold or transferred in any manner whatsoever.
f. Reward Points accrue on bookings made from 1 January to 31 December of each calendar year and must be redeemed during that period. Reward Points expire on 31 December of each calendar year. Any unredeemed points automatically expire.
g. Reward Point balances can be viewed online at the URL provided by GTA from time to time.
h. It is the Participants’ responsibility to check that there are sufficient points to redeem any requested Reward.
i. Client (or Participant as the case may be) must regularly check that Reward points have been properly credited.
j. Any discrepancies in any transaction must be notified to GTA within three (3) months of that transaction. GTA may in its sole discretion, but acting reasonably, decline to make any amendments for discrepancies notified outside this period. This does not affect any rights which may be available at law.
k. All GShop products are subject to availability and restrictions apply. Client shall ensure that its employees and agents are aware of and have agreed to these terms and conditions.
C. VARIATION AND TERMINATION
a. GTA can, on reasonable prior notice, suspend or vary or terminate GShop at any time.
b. GTA may vary these terms and conditions at any time on prior notice.
a. The Participant and/ the Client is solely responsible for any government tax, duty or charges imposed by law in any country in respect of GSHOP or any Reward redeemed via GSHOP or by virtue of the participation in the GShop Rewards Program or the accumulation of Reward Points.
E. LIABILITY AND WARRANTY
a. Participant must not engage in conduct which is unlawful or illegal or which brings GTA into disrepute or engage in conduct which is in breach of these terms and conditions. GTA may terminate participation in the GShop Rewards Program should GTA reasonably believe that a Participant and/the Client has breached any of these terms and conditions. Termination of participation in GShop shall not affect the validity of the Contract.
b. To the extent permitted by law, warranties, if any, are provided by Retailers and not GTA. GTA does not accept liability for defects in quality or condition of Rewards offered or redeemed on GShop.
b. These terms and conditions constitute the entire agreement relating to the GShop Rewards Program and supersedes any previous terms and conditions or agreement relating to the GShop Rewards Program.
c. These terms and conditions are governed by the laws of Hong Kong and the parties submit to the jurisdiction of the courts of Hong Kong.
